PARTICIPANT TERMS AND CONDITIONS
1. APPLICABILITY
These terms and conditions are applicable to all candidates and participants (hereinafter, the PARTICIPANT(S)) of the program (hereinafter, the PROGRAM) taught by Higher Education in Law, Economics and Geopolitics of Professional Sports SRL (hereinafter HELEGS)
2. HELEGS’s ACADEMIC COMMITMENTS
- Lecturers
HELEGS, with its best judgment, selects the most suitable lecturers for the PARTICIPANT and proper monitoring thereof, the most updated materials, and the best methodology that allows PARTICIPANTS to attain the highest achievement in the PROGRAM.
- Modification of contents
HELEGS reserves itself the right to make any necessary changes in the structure and content of the PROGRAM, in order to offer the best training and the latest materials to the PARTICIPANT.
- Access to the program
Enrollment includes unlimited access to the platform and all PROGRAM materials, including any future updates as long as HELEGS offers and operates the PROGRAM.
- Completion certificate
Once the PROGRAM has been completed and HELEGS has verified that the PARTICIPANT has done her/his work correctly, the PARTICIPANT will receive the corresponding certificate. The PROGRAM offered by HELEGS will be a professional non-university qualification. Candidates who withdraw from the PROGRAM will not be entitled to obtain any certificate.
3. CONDITIONS FOR ENROLLMENT
- Admission process for candidates
Candidates may apply for participation in our PROGRAM in accordance with the specific instructions outlined on our website and our application form. Candidates are responsible to provide true, accurate, current and complete information at the time of their application. The lack of honesty in the information provided may result in the immediate dismissal from the PROGRAM.
Candidates’ applications will be reviewed by our applications committee. Candidates will receive a response by email within 3 working days. Candidates who are admitted will be given 3 working days to pay the PROGRAM registration fee.
- Tuition and other amounts owed to HELEGS
The payment of the tuition implies the commitment on the part of the PARTICIPANT to occupy an irreplaceable spot. Said commitment is always due in its entirety, even if it is divided into installment payments. Therefore, if the PARTICIPANT incurs in temporary or permanent withdrawal once the right of withdrawal (money back guarantee) has expired, she/he will not be exempted from full payment of the tuition.
Non-payment of tuition, any taxes, or other amounts due to HELEGS may result in denial of access and continuity in the PROGRAM.
- Modification or cancellation of the call for applications by HELEGS
HELEGS reserves the right to cancel or delay the start of the PROGRAM when circumstances beyond its control occur that make it impossible to develop the PROGRAM correctly or when the number of participants enrolled does not guarantee the minimum quality. This decision will be duly communicated to those affected PARTICIPANTS.
In such case, the PARTICIPANT may choose to:
- receive a refund of the amount paid to date, or
- reserve a place for the next edition of the PROGRAM.
- Changes by the PARTICIPANT
The PARTICIPANT may request two changes of course dates. Applications for convocations that are not consecutive to the Participant’s original convocation will not be accepted.
The administrative management fees for a convocation change request by the PARTICIPANT amount to €200 for the first request and €400 for the second request.
If the PARTICIPANT does not attend the PROGRAM after two changes of the course, she/he will lose her/his place and will not be able to claim the amounts paid to HELEGS as registration.
4. RIGHT OF WITHDRAWAL (MONEY-BACK GUARANTEE)
The individual PARTICIPANT has the right to withdraw her/his purchase before starting the fourth module of the PROGRAM.
To exercise her/his right of withdrawal, the PARTICIPANT must, within the time limit set out below, send to the email address administration@helegs.com, an unambiguous statement expressing her/his desire to withdraw.
HELEGS will pay the PARTICIPANT back without asking questions and without conditions.
HELEGS will process a refund for the full amount paid to date by the PARTICIPANT within 5 working days.
Reimbursement will be made via the same means of payment used by the PARTICIPANT for the initial transaction.
The request for withdrawal of the registration once the fourth module of the PROGRAM has started will not entitle the PARTICIPANT to any type of refund.
5. ABSENCE OF RIGHT OF WITHDRAWAL
Purchase made by a company or sport organisation (federation, association, club, league, players' union, law firm, media organisation, consulting firm, agency, brand, etc.) shall not have the right of withdrawal.
6. PARTICIPANT RESPONSABILITIES
- Grounds for refusal of access and continuity in the program
HELEGS reserves itself the right to deny access and continuity in the PROGRAM to participants who show a behavior that affects the normal functioning of online classes, webinars, live group session, forum or engage in activities that violate their code of conduct, such as:
- The dissemination, without proper authorisation, of materials provided during or at the completion of the PROGRAM.
- The use of personal username and password to access the Virtual Campus by more than one person.
- Carrying out activities that violate the intellectual property rights of HELEGS, their lecturers or peers.
- Lack of respect for people and ideas.
- Lack of respect to HELEGS’s staff and lecturers.
- Misuse of classes, teaching materials and HELEGS resources.
- Plagiarism or misconduct in performing academic tasks.
- Serious breach of Academic Regulations.
The Program Directors and Program Manager of HELEGS assess the facts and take appropriate decisions after receiving the views of all parties implicated in the matter.
Disrespect to the Academic regulations and low performance within the PROGRAM may also be cause for denial of appropriate access and continuity.
The refusal of access to the PROGRAM or low performance in it will imply the denial of the Completion Certificate of the PROGRAM.
- Respect of Academic Regulations.
The PARTICIPANT is committed to reading the topics and readings, correctly performing the assessment tests that are proposed, taking an active participation in live group sessions and performing, if applicable, other tasks to be established within the PROGRAM to the maximum extent possible.
It will be the PARTICIPANT’S responsibility to behave in accordance with HELEGS’s General Regulations, as well as with the provisions of the PROGRAM’s Specific Regulations. Proof of non-compliance by the PARTICIPANT with the aforementioned regulations will result in expulsion from HELEGS, without the right to any refund or claim whatsoever.
7. DATA PROTECTION AND IMAGE
All data and information provided before, during and after completing the activities of the PROGRAM will be processed by HELEGS, in order to manage the academic relationship with the Institution, including the management of personal data and image of the PARTICIPANTS, to be incorporated in documents and publications (graphic and/or audiovisual) of academic and/or promotional type of HELEGS and to offer services, academic and promotional information (by electronic and non-electronic means) of HELEGS.
The rights provided for in the privacy regulations in force may be exercised by sending your request to HELEGS to its Data Protection Delegate at info@helegs.com. Likewise, the PARTICIPANT has the right to file a complaint before the competent Data Protection Authority.
The PARTICIPANT authorizes HELEGS to proceed to the use of its image in any support or format that HELEGS deems convenient, free of charge, for the fulfillment of all or some of the purposes informed above.
8. CONFIDENTIALITY
The PARTICIPANT assumes an indefinite duty of strict confidentiality and secrecy with respect to all confidential information to which the PARTICIPANT has access due to his/her participation in the PROGRAM. For these purposes, confidential information includes all information, whether of HELEGS or of any entity collaborating with HELEGS, of an economic, financial, technical, commercial, strategic, administrative or any other type to which the PARTICIPANT has access, especially that relating to reports, software, installations, methodologies, products, know-how, services, users of services, customers, commercial activities, as well as data and information of a personal nature, collected in any medium, and documentation of any other type that has been classified as proprietary or confidential or that, by its nature or by the circumstances in which the disclosure or creation occurs, must in good faith be considered as such.
In addition, the PARTICIPANT is required not to use for their own or others’ purposes, nor disclose to any third party, confidential information that has been entrusted to them and/or of which they have become aware on the occasion of their participation in the PROGRAM.
Exceptions to the above are that information which becomes public or that which must be disclosed in accordance with the laws, judicial resolution and/or imperative act of a competent authority.
The disclosure of confidential information does not constitute, in any case, a transfer or license, explicit or implicit, in favor of the PARTICIPANT on any rights of which the entity to which it belongs, is the holder.
In case of breach of the above confidentiality commitment, the PARTICIPANT will be immediately dismissed from the PROGRAM, with loss of all the benefits inherent in being a PARTICIPANT and/or former PARTICIPANT of HELEGS and must pay the amount of the tuition pending at the time of dismissal, if not already paid, and without prejudice to any compensation and/or legal actions that HELEGS and/or the collaborating entity may exercise in defense of any rights they have recognized, all of which are expressly reserved.
9. MISCELLANEOUS
- Use and Rights of Participants’ Work
HELEGS may make use of any type of contribution made by the PARTICIPANT during the PROGRAM without the express written consent of the PARTICIPANT.
The PARTICIPANT grants HELEGS, free of charge, the rights (including, but not limited to, intellectual and/or industrial property rights) that may derive from the materials and/or contents developed in whole or in part, directly or indirectly, as a result of the PROGRAM, without any spatial and/or temporal limitation in accordance with the provisions of the current legislation.
- Force Majeure and Fortuitous Event
In the event that the normal development and provision of the educational services may be affected by any event beyond HELEGS’s reasonable control, HELEGS reserves the right to activate the contingency protocols it deems necessary and to postpone, if necessary, their provision until the event in question is over.
- Jurisdictions
The Terms and Conditions constitutes the entire agreement between the PARTICIPANT and HELEGS. All previous agreements, arrangements and understandings between the PARTICIPANT and HELEGS relating to his/her admission on to the PROGRAM, whether written or oral, shall have no legal effect unless expressly set out in the Terms and Conditions.
The Terms and Conditions, and any other matters arising out of or in relation to the Terms and Conditions, are governed by and construed in accordance with Belgium law.
Any disputes arising out of or in connection with the Terms and Conditions and the PROGRAM shall be finally settled by the Courts of Brussels, Belgium, which will apply their own substantial and procedural laws, i.e. Belgian law.
